Associate Professor Daniel Aaron, an expert in tort and health law, and 2L Avery Emery recently co-authored an article in the Journal of the American Medical Association (JAMA) entitled “U.S. Supreme Court Limits on the Power of U.S. Health Agencies.” They also collaborated on an opinion editorial for the Deseret News.
Both the article and editorial focus on the Chevron deference, which, if the Supreme Court overturns it, would severely limit the ability of federal agencies such as the FDA, CDC and EPA to develop and implement scientifically sound regulations. This decision could have profound impacts on public health and the environment.
