Legislature
- Professor Rosky drafted the original language of SB 103 (2019), Utah’s first law to explicitly prohibit hate crimes based on age, disability, homelessness, race, religion, sexual orientation, gender identity, and other characteristics. He received an Equality Award from Equality Utah recognizing his work on this historic law.
- Paul Cassell frequently provides advice to federal and state legislators on drafting legislation to protect crime victims’ rights.
- Paul Cassell worked closely with Senators Hatch and Schumer in drafting the Amy, Vicky, and Andy Child Pornography Victim Assistance Act of 2018, which provides expansive restitution for victims of child sex abuse imagery crimes.
- Clinical Professor Jensie Anderson works with the Utah Legislature, the Nevada Legislature and the Wyoming Legislature, as well as with the National Innocence Project, in passing laws that provide innocent individuals access to the state courts. Over the last fifteen years, she has helped to write and pass Utah Code Ann. § 78b-9-401 et. seq (the Utah Post-Conviction Determination of Factual Innocence Statute), Wyoming Statute Annotated § 7-12-400 et seq. (Post-Conviction Determination of Factual Innocence Act), and Nevada Revised Statutes Annotated 34.900 et seq. (Petition to Determine Factual Innocence). Professor Anderson has also be instrumental in the DNA testing and compensation laws passed in both Utah and Nevada.
- Clinical Professor Jensie Anderson also works closely with the legislatures in Utah, Wyoming and Nevada to pass laws that address the primary causes of wrongful conviction. In 2022, Professor Anderson assisted to pass Utah Code Ann § 80-6-206 which prohibits a police officer from knowingly misrepresenting the available evidence or the possibility of leniency when interrogating a juvenile. Utah was only the second state, after Illinois, to pass such a law.
- In 2022, Clinical Professor Jensie Anderson worked tirelessly to pass an evidence preservation statute in Utah not only requires that biological evidence be preserved for the length of a sentence or until a cold crime is solved, but also provides remedies, including a presumption of innocence in the post-conviction, that the evidence would have been exculpatory, if it is prematurely destroyed. Utah Code Ann. § 53-2-101 et seq; Utah Code Ann. § 78b-9-104 (1)(f).
- In 2023, Professor Anderson worked with stakeholders in the Nevada criminal justice system, including the Nevada Prosecutors Association, to write and pass Nevada AB101 which will help to reform the jailhouse informant practices in Nevada. In addition, she testified on Nevada AB193 which reforms the law relating to the interrogation of juveniles and prohibits police officers, in most instances, from making false statements when interrogating a child.
- In 2019, Professor Anderson also worked closely with the Supreme Court’s Standing Committee on the Rules of Evidence to enact Utah Rule of Evidence 617 which deals extensively with the reliability and admissibility of eyewitness identification testimony.
